Aggravated DUI

Kentucky imposes harsher penalties when “aggravating circumstances” are present. They are:

  1. Speeding 30 miles per hour over the speed limit
  2. Going the wrong way on a limited access highway
  3. Causing an accident resulting in death or serious injury
  4. Having a BAC of 0.15 or more
  5. Refusing to submit to a breath or blood test
  6. Having a passenger under 12 years of age
